TERMS & CONDITIONS: PHILIPS MALAYSIA SOCIAL MEDIA PERSONAL CARE HAMPER LEAD GENERATION CAMPAIGN

 

1. Terms and Conditions: These Terms and Conditions, together with the Philips Privacy Policy which is incorporated by reference into these Terms and Conditions (available at https://www.philips.com.my/a-w/privacy-notice.html) (Terms) contain the entire understanding and agreement between Philips (the Promoter) and entrants of the Promotion (the Entrants) in relation to the Philips Product hamper competition promotion (the Promotion). Entry into the Promotion is deemed to be an acceptance of these Terms.

    

NOTE: This Promotion is to build brand awareness of Philips’ products. This Promotion is NOT a sales incentive program to recommend Philips’ products to end customers.

 

2. Promoter: The promoter for the Promotion is Philips Malaysia Sdn Bhd  of  Level 9, Menara Axis, 2, Jalan 51A/223, 46100 Petaling Jaya, Malaysia (“Promoter”).

 

3. Promotional Period: The Promotion commences at 00:00 SGT on 3 May 2021 and ends 23:59 SGT on 30 June 2021 (“Promotional Period”).  The duration of the Promotional Period shall not be extended except as notified by the Promoter.

 

4. How to Enter: To enter the Promotion on Facebook you will be required to subscribe to the Philips database by entering your email address, name, age and answer the question “Which is the perfect Philips Personal Care product for you and why?”

 

Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Promoter. If an Entrant uses fraudulent methods or otherwise attempt to circumvent the rules, the entry may be removed from eligibility at the sole discretion of the Promoter. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

5. Multiple Entries: Entrants must enter the Promotion in their own name. There are no limits on the amount of entries that an Entrant can submit, provided these Terms are complied with on each occasion. The use of automated entry software or other mechanical, electronic or other means that allow an Entrant to automatically enter the Promotion repeatedly is prohibited and will render all entries submitted by the Entrant invalid.

 

6. Eligibility and Participation: This Promotion is only open to individuals who are 18 years and above as of the date of entry, who enter during the Promotional Period. The Promotion is only open to legal residents of Singapore and is void where prohibited by law. Corporations, companies, body corporate bodies, groups, organizations and any other corporate bodies and non-corporate bodies are not eligible to participate. By entering this Promotion, each Entrant represents and warrants that s/he meets the eligibility requirements of these Terms.

 

This Promotion is valid only for new members (who do not already have a MyPhilips account). Each participant who completed the actions stated under “Sign up” during the Campaign Period will be eligible for the Campaign.

 

Prizes: A Product hamper with a number of Philips products.

 

The actual/appraised value of the Prize is subject to change. In the event of the Prize being unavailable and the Promoter has used all reasonable efforts to arrange the Prize it reserves the right to substitute Prize of equal value subject to any directions from a regulatory authority.

 

Any and all expenses incurred by Entrants, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winners (defined below). No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent by the winner is permitted.

 

7. Judging date and venue: The winner of the Prize will be the best valid entry submitted as judged by the judging panel, having regard to skill, creativity and originality (each a Winner and Collectively the Winners). Judging will take place at 622 Lorong 1 Toa Payoh, Singapore 319763 on 12th July 2021 9:00 AM (Judging Date). The Promoter’s decision is final and no correspondence will be entered into.

 

8. Game of skill: This is a game of skill and chance plays no part in determining the Winner. As such, the winning entry or entries are selected based on the quality of entries submitted and are made at the sole discretion of the judges. The decision of the judging panel is final and binding and no correspondence will be entered into.

 

9. Notification: The Winner will be notified via email to the email address provided on the online form for the Promotion by 16th July 2021, 6 PM (Notification Date). The E-mail will contain instructions on how to contact the Promoter and redeem the Prize. This is within five (5) business days of the Winner being selected on 12th July 2021 9:00 AM at 622 Lorong 1 Toa Payoh, Singapore 319763.

 

The Promoter shall have no liability for a Winner's failure to receive notices due to Winner’s spam, junk email or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information. If the selected Winner cannot be contacted, is ineligible or fails to claim the Prize within fifteen (15) business days from the date that the award notification was sent (the “First Redemption Period”), the Prize will be forfeited and no longer capable of being claimed by the Winner.

 

10. Redemption Period: The Redemption Period, during which the Winner may claim the Prize, commences on 16th July 2021, 6 PM and ends on 6th August 2021, 6 PM (Redemption Period).

 

11. Unclaimed Prize and Second Notification Date: If the Prize remains unclaimed by the end of the Redemption Period, an alternative Winner (Alternative Winner) will be selected on 10th August 2021, 9:00 AM at 622 Lorong 1 Toa Payoh, Singapore 319763 (Second Judging Date). The Alternative Winner will be notified via E-mail within 24 hours of the Second Judging Date (Second Notification Date).

 

12. Second Redemption Period: In such a case, a second redemption period, during which the Prize may be claimed by the Alternative Winner commences on the Second Notification Date and ends on 31st August 2021, 6 PM (Second Redemption Period). The Alternative Winner will be notified via E-mail at the start of the Second Redemption Period. If the Alternative Winner does not claim the Prize within fifteen (15) business days from the Second Notification Date, the Prize is deemed to be forfeited and no longer capable of being claimed by the Alternative Winner. In such a case, it is up to the Promoter to decide, in its sole discretion, how many more determinations and redemption periods to allow.

 

13. Delivery: The Prize will be delivered to the address supplied by the Winner within 4 weeks after the Winner provides said address (Delivery Date). To the extent permitted by law, the Promoter will not be responsible for a delay in delivering the Prize by the Delivery Date where such delay has been caused by a third party.

 

14. Rights Granted: By entering this Promotion Entrants understand that the Promoter, anyone acting on behalf of the Promoter, or its respective licensees, successors and assigns will have the right, where permitted by law without any further notice, review or consent to: print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, the Entrant’s entry, including, without limitation, the entry and Winner's name, portrait, picture, voice, likeness, image or statements about the Promotion, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

 

15. Rights of the Promoter: The Promoter reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) a virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such case, the Promoter may select the Winner or Alternative Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Promoter. The Promoter reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms.

 

The Promoter has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for breaching the Terms, including multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros or scripts or other technical means for entering.

 

16. Lazada Promotion Code(s): Promotion code(s) will be sent to the email ID of all consumers who sign up via our social campaign during the promotion period.

 

Customers who make online purchases at the Philips Store in Lazada have to enter the promotion code given out from Lazada (“Promotion Code”) upon checkout. 

 

The Promotion is only applicable for products listed on the Philips Official Store in Lazada. 

 

The Promotion is applicable to full payment transactions only and not valid for instalment payments.

 

Other discounts/promotions/vouchers, including Philips Birthday Promotion, Philips New Member Welcome Promotion and any free premium/gifts redemption, are not applicable to this Promotion.

 

All items under this Promotion on the Philips Store in Lazada are on a while stocks last basis. Items sold under this Promotion are non-exchangeable and non-refundable.

 

17. The following provisions apply to the Promotion Code(s):

 

a.   There is no free delivery/ shipping for products purchased using the Promotion Code(s) unless expressly stated otherwise.

b.   Promotion Code(s) are not transferable or redeemable for cash and/or credit.

c.   Promotion Code(s) cannot be used for sales items and/ or with any other promotions/ vouchers unless expressly stated otherwise.

d.   The Promoter is not required to provide any vouchers, discounts, credits, cash or any other form of compensation for discontinued or cancelled Promotion Code(s).

e.   There shall be no reselling or trading of the Philips products purchase with this Promotion.

 

18. The use of the Promotion Code to purchase the products at the Philips Official Store in Lazada shall be subject to Lazada’ general terms and conditions of sale to consumers at  https://www.lazada.com.my/terms-of-use/?spm=a2o4k.helpcenter-article.article-content.1.2c846b7aFzEP10  (Lazada’s General T&Cs”). 

 

The Promoter reserves the right to validate and check the authenticity of the order, and to disqualify any customer for tampering with the order process, or who submits an order that is not in accordance with these Terms and Conditions and Lazada General Ts&Cs. Breach of these Terms and Conditions and Lazada General Ts&Cs will render any discount provided by the Promotion Code(s) void.

 

These Terms and Conditions may be amended by the Promoter at its discretion. All visuals are for illustration purposes only.

 

The Promoter reserves the right to modify or cancel any order or revoke the use of any Promotion Code(s) for any reason including suspicious or fraudulent activities, misuse of the Promotion Code(s) or breach of these Terms and Conditions, without incurring any liability. The decision as to the right to use of the Promotion Code(s) will be at the complete discretion of the Promoter and no correspondence will be entered into.

 

The Promoter accepts no responsibility for any variation in price of the product(s) from other suppliers.

 

Any tax liability arising as a result of purchasing any product(s) is the responsibility of the customer.

 

19. If for any reason this Promotion is not capable of running as planned, including without limitation,  infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the process, and/or to cancel, terminate, modify or suspend the Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration in relation to the Promotion. 

 

20. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to customer’s or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. 

 

21. Legal Warning: Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promoter’s website, or the information on the website, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

 

22. Liability: In consideration for the Promoter accepting the Customer’s participation in the Promotion, to the fullest extent permitted by law, Customer releases and forever discharges the Promoter from all claims that Customer may have or may have had but for this release arising from or in connection with any Customer’s participation in this Promotion. Customer indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person, arising as a result of or in connection with Customer’s participation in the Promotion.

For the purposes of this clause, claim(s) means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising.

 

Any costs incurred by an Entrant associated with participating in the Promotion, including accessing the Promoter’s website or telephone enquiries in relation to the Promotion, are the sole responsibility of the Entrant. 

 

23. Force Majeure: If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and prevents the Promoter from complying with these Terms, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.

 

24. Privacy: This Promotion is subject to the laws of Malaysia, the Personal Data Protection Act 2010 (“PDPA”) and Promoter’s Privacy Policy located at:  https://www.philips.com.my/a-w/privacy-notice.html . The Promoter collects personal information (“PI”) in order to conduct the Promotion, and may for this purpose, disclose PI to third parties, including but not limited to agents, contractors and service providers and to any government authorities and agencies.  This Promotion is conditional on customer providing his/her PI.  Please read the Promoter’s Privacy Policy carefully to understand how the Promoter may use customer’s PI and rights of customer. By reading and accepting these Terms and Conditions in full and by providing customer’s PI when purchasing the products using the Promotion Code(s), customer hereby consent to the Promoter collecting, using, disclosing and processing customer’s PI for purposes of the Promotion in accordance with the PDPA and Promoter’s Privacy Policy.  

 

25. The Promoter's decisions are final and no correspondence will be entered into, including in the event of a dispute. The products purchased must be taken as offered and cannot be varied.

 

26. These Terms and Conditions constitute the entire agreement of the parties relating to the participation and the conduct of the Promotion.
