1. The following terms and conditions (“Terms and Conditions”) shall govern your participation in Refund Promotion. By participating in the Refund promotion, you are deemed to have agreed to these Terms and Conditions. The Refund Promotion is not valid in conjunction with any other offer.

2. Participation in the Refund Promotion is only open to Malaysia residents aged eighteen (18) years or above. Employees of Philips and their immediate family members, participating retailers and agencies associated with or directly involved in the Refund Promotion are not eligible to participate in the Refund Promotion. Immediate family members means any of the following spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3. To participate in the Refund Promotion, you must purchase an eligible Philips product with model number HD9623/11, HD9623/31, HD9643/11, GC7808/40, GC9622/20, GC9630/20, GC9660/36, GC9670/56, GC3920/26, GC3929/66, GC4933/80, GC5030/20, GC5039/30 (each an “Eligible Product”) from 01 March 2018 to 30 April 2018, both dates inclusive (“Purchase Period”) from – a participating Philips’ store.

4. When you purchase an Eligible Product, you can take advantage of 14 days trial offer. This entitles you to claim your money back, if you are not entirely satisfied with the performance of the Eligible Product product purchase (subject to Terms and Conditions).

5. You have up to fourteen (14) days from the date of purchase as noted on the official purchase receipt (“Refund Period”) to try the Eligible Product and you must return the Eligible Product prior to the expiry of the Refund Period should you be dissatisfied with the Eligible Product.

6. The Refund Promotion is in addition to the manufacturers’ warranty offered for the Eligible Product.

7. The Eligible Product must be used strictly for domestic usage only and not to be used for commercial purposes.

8. If the appliance has been mishandled, dirty or used other than as set forth in the product manual or has any user induced defects observed, including but not limited to dent and scratch, the Eligible Product cannot be returned for a refund under the Refund Promotion. In such scenario, you will own the product and the repairs charges will be at your cost and you will need to bring the product to Philips authorized service center.

9. Subject to terms and conditions herein, you must undertake the following steps to submit a claim for the Refund promotion:

a.  Obtain a Money Back Guarantee claim form from the participating Philips’store

b. Fill out the Money Back Guarantee claim form with complete information as requested on the form;

c.  Contact Philips Consumer Care line (1800-880-180) to get the details on the nearest consumer care centre. Submit the completed form and bring the Eligible Product in its original packaging together with a copy of the purchase receipt to the nearest Philips Consumer Care Centre. The business hours specified below:

i.     Monday to Friday: 9am to 6pm

ii.     Saturday: 9am to 1pm

iii.     Sunday: Close

10. Money Back Guarantee claim form that is incomplete, indecipherable or illegible or failure to submit a claim will not entitle to any claim or refund in connection with the Refund Promotion.

11. You must retain their original purchase receipt and the Eligible Product packaging as proof of purchase and for the purposes of submitting a claim. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Philips Consumer Care, result in invalidation of your claim and forfeiture of any right to a refund in connection with the Refund Promotion. The purchase receipt must clearly specify the Promoter of purchase and that the purchase was made during the Purchase Period but prior to submitting a claim.

12. The Philips Consumer Care reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and to disqualify a claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Failure by the Philips Consumer Care to enforce any of its rights at any stage does not constitute a waiver of those rights.

13. Only one (1) claim permitted per household

14. If there is a dispute as to the identity of a claimant, the Philips Consumer Care reserves the right, in its sole discretion, to determine the identity of the claimant.

15. Refunds will be issued in cheque within 30 days upon verification.

16. Where applicable you will be notified in writing and phone call as to whether you are entitled to the refund in connection with the Refund Promotion. The Philips Consumer Care decision on the condition of the Eligible Product is final and no correspondence will be entered into.

17. The Philips Consumer Care reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; (b) to modify, suspend, terminate or cancel the Refund Promotion; or (c) to amend or change these Terms and Conditions, as appropriate.

18. Any cost associated with accessing the Internet is dependent on the Internet service provider used. The Philips Consumer Care makes no guarantee as to the availability of its web services and will not be held responsible for interruption of services that may interfere with the ability to participate in the Refund Promotion.

19. The refund is not transferable or exchangeable and can only be made out to the claimant who purchased the Eligible Product

20. Except for any liability that cannot by law be excluded, Philips (including their respective officers, affiliated companies, employees and agents) exclude all liabilities for any personal injury, illness or death of any person; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Refund Promotion.

21. The Promoter and Philips collect personal information ("PI") in order to conduct the Refund Promotion and may, for this purpose, disclose PI to third parties, including but not limited to agents, contractors and service providers. Claim is conditional on providing this PI and without this PI and the information on the claim form, Promoter will not be able to process the Claim and the claimant may not be able to make the Product return. In addition to any uses that may be outlined in Philips’ Privacy Policies, if the claimant opts-in by ticking the opt-in box at the time of submitting their claim, each claimant then consents to the information they submit, being entered into a database of the Promoter and Philips and for this information to be used, for an indefinite period, unless otherwise advised, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All personal details of the claimant will be stored by the Promoter and Philips and are subject to Philips’ Privacy Policy, see http://www.philips.com/a-w/privacy-notice.html. Please contact Philips to request to opt out, access, update or correct any information. All claims become the property of Philips Malaysia.
